Kancelář architekta města Brna, příspěvková organizace (Brno City Chief Architect‘s Office, contributory organization) (hereinafter the “KAM”), based at Zelný trh 331/13, 602 00 Brno, which was established by the Statutory City of Brno via a Charter as of 1 February 2016 based on the decision of the Brno City Council at the meeting Z7/14 on 18 December 2015, declares that it protects the personal data of users within the meaning of Article 6(1)(A) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data (hereinafter the “Regulation”), to the extent of personal data necessary to fulfill the rights and obligations arising from the reasons set out below.

As the administrator of your personal data, we will process it in accordance with the below conditions.

1. What personal data do we process?

We only process personal data that you provide to us in connection with the following situations:

Newsletter

By subscribing to the newsletter on the kambrno.cz and kambrno.com websites, you provide us with the following personal data:

  • email address.

Websites, Facebook and other social networks

As a visitor, fan and follower of our Facebook page and other social networks (Instagram, Youtube and others) you provide us with the following personal data:

  • IP address;
  • cookies;
  • or other online identifiers. 

When you visit or leave our website, Facebook or other social network (including our plug-ins, cookies or similar technologies on other websites), we obtain the URL of both the website you came from and the website you left for. We also obtain information about your IP address, proxy server, operating system, web browser and plug-ins, device identifier and functions, and your provider of internet or mobile services. If you visit our website, Facebook or other social networks on a mobile device, this device will send us information about your location depending on your phone’s settings.

KAM events

We collect your personal data when you register for events organised by KAM via kambrno.cz and kambrno.com websites, the social network Facebook or via the Google Forms service. We also collect your personal data whey you register in the attendance list during personal participation in events.

We process your personal data to the extent necessary for you to provide it to us in connection with your participation in the event for which you have registered, namely:

  • your name and surname;
  • email address;
  • phone – only if you wish so;
  • place of residence – the name of a city district in Brno or of your city or town;
  • photos of your person without further identification.

Please note that we take photographic and audiovisual recordings at our events, which are used to further promote our events and present our activities. If you participate in an event, you acknowledge that these records will be taken and that we may use them to promote and inform about KAM events and activities.

We publish photos and audiovisual recordings on our websites kambrno.cz and kambrno.com, on our Facebook profile and on other social networks, as well as in promotional materials of KAM. We do not mark a person’s name or other identifier in any way on published photographs or audiovisual recordings. You can download the photos and use them for your personal use, not commercially.

Job seekers

If you send us your CV for a selection procedure or if you send us your CV on your own initiative, we will keep it only for the necessary period, i.e. until the end of a selection procedure, which does not exceed three months.

We will process your personal data for the purpose of selecting a suitable employee and negotiating an employment contract for a given position, and only to the extent necessary for the implementation of measures involving mutual negotiations and evaluation by our organization before concluding an employment contract. Personal data so processed include the following:

  • your name and surname;
  • date of birth;
  • place of residence;
  • email address and telephone number;
  • data on your education;
  • data on your work experience;
  • other information that you provide in your CV; in the event that you provide additional personal data in the CV, it is considered your free decision to provide this data to us and we will therefore also process this personal data provided by you for the purposes of the selection procedure.

In none of the cases do we use automated decision-making on the selection of candidates, including profiling based on this automated processing.

Competition participants and panel members

If you enter an architectural / urban competition organized by KAM, we will process the following personal data:

  • your name and surname;
  • company ID No in the case of self-employed persons;
  • account number;
  • place of residence;
  • email address and telephone number.

Panel members and invited experts who are approached to participate in an evaluation panel of a given competition provide KAM with the following:

  • a photograph for the purpose of publication in the competition conditions;
  • email address and telephone number;
  • company ID No in the case of self-employed persons;
  • account number;
  • place of residence;
  • professional profile.

2. Why do we process your personal data and what is the legal basis for their processing?

We process your personal data for the following purposes:

  • sending a newsletter and informing about the activities of KAM, as well as for the purpose of promoting and improving our services; the legal basis is a legitimate interest on the basis of Article II(2)(h) of the KAM charter (ensure presentation, promotion and communication with the public in the field of spatial planning and development, care of public space and spatial information infrastructure);
  • finding out what data you are interested in on our website; the legal basis is a legitimate interest on the basis of Article II(2)(h) of the KAM charter (ensure presentation, promotion and communication with the public in the field of spatial planning and development, care of public space and spatial information infrastructure);
  • sending invitations to events organized by KAM; the legal basis is a legitimate interest in promoting such events;
  • for the purpose of competitions and the recruitment of new staff; the legal basis is a legitimate interest in filling vacancies;
  • documentation of individual events in the case of photographs and video recordings; the legal basis is a legitimate interest in promoting of our services;
  • for the purpose of organizing competitions; the legal basis is a legitimate interest on the basis of Article II(2)(d) of the KAM charter (ensure the organization of urban and architectural competitions).

3. How long do we process your personal data?

We will process your data for the time necessary for your participation in a given event. In the case of sending a newsletter, from the time you provide your consent to the processing of personal data until you revoke it. Furthermore, we store some personal data for the time necessary to fulfill the archiving obligations under applicable law, such as the Accountancy Act, the Archives and Records Act or the Value Added Tax Act, this period is usually 10 years at the longest. We will keep the CVs you sent for our selection procedure or the CVs you sent on your initiative only for the necessary period, i.e. until the end of the selection procedure, which does not exceed 3 months.

Therefore, we therefore store your personal data for the time strictly necessary to provide the services and complete the required transactions or for other necessary purposes, such as compliance with our legal obligations or dispute settlement. These needs may vary for different types of data in the context of different situations, and therefore the actual storage period may vary significantly. The criteria on the basis of which the storage period is determined include the following:

  • How long is personal data needed to keep our organization running? This includes activities such as maintaining the security of our systems and maintaining appropriate business and financial records. This is a general rule, which is the basis for determining the storage period in most cases.
  • Do you provide us with your data with the expectation that we will store it until you explicitly want to delete it? If so, we will process them until you ask us to delete them. Are these personal data sensitive? If so, it is generally appropriate to use a shorter data storage period.
  • Have we implemented and announced a specific storage period for a particular type of data? If so, we will definitely never exceed it.
  • Have you given your consent to extend the storage period? If so, we will store the data in accordance with your consent.
  • Do we have legal, contractual or similar obligations to store data? Examples include laws governing mandatory data storage, government regulations to store data related to investigations, or data that must be store for litigation purposes.

4. Can we process your personal data without your consent?

Yes, we may process your personal data without your consent, but only for the following purposes:

  • fulfillment of legal obligations which result for us from generally binding legal regulations or from a contract;
  • processing that is necessary for the purposes of our legitimate interests (e.g. ensuring the security of our website);
  • for the purposes of performing a contract.

The possibility and legality of such processing follows directly from the applicable legal regulations and your consent to such processing is not required.

5. Where will we process your data?

We process your personal data in KAM computer systems. In the case of newsletter distribution, we provide data to the MailChimp service, which is operated by The Rocket Science Group. When registering for KAM events, we provide information to Google Forms by Google LLC. Although these cases involve the transfer of personal data to third countries where both companies are based outside the EU or the EEA, you do not have to worry about your data as both companies are on the EU Privacy Shield list and according to the EU decision provide sufficient protection for your personal data from the point of view of GDPR.

6. How secure are my personal data?

All personal data you provide to KAM are secured by standard procedures and technologies. However, complete security cannot be objectively guaranteed, so it is not possible to fully ensure that our security measures will not be compromised and that a third party will not gain unauthorized access to your personal data, and that it will not be copied, published or destroyed.

However, we try to prevent any possible misuse of your personal data. We regularly check our system for vulnerabilities or evidence of past attacks. We use security measures to prevent unauthorized access to your personal data which provide sufficient security in view of the current state of technology. We regularly update our security measures. Nevertheless, should a security attack affect your personal data, we will notify you without undue delay.

7. How and when can you withdraw your consent to the processing of personal data?

You can revoke your consent to the processing of personal data at any time, free of charge, in the following ways:

  • by sending an email with a request to the address [email protected];
  • by clicking on the unsubscribe link at the end of our newsletter;
  • by sending a written request to the address Zelný trh 331/13, 602 00 Brno.

Withdrawal of consent does not affect the processing of personal data that we process on a different legal basis than the consent given by you (i.e. especially if the processing is necessary to fulfill a contract, legal obligation, legitimate interest or for other reasons specified in applicable legal regulations).

8. What rights do you have in relation to the protection of personal data?

In particular, you have the following rights in relation to your personal data:

  • the right to withdraw your consent at any time;
  • the right to correct or supplement personal data;
  • in certain cases, the right to request restriction of processing;
  • in certain cases, the right to object to the processing and to lodge a complaint with the Office for Personal Data Protection;
  • in certain cases, the right to request the transfer of data;
  • the right of access to personal data;
  • in certain cases, the right to be informed of a breach of security of personal data;
  • in certain cases, the right to erasure of personal data (the right to be “forgotten”),
  • other rights stipulated in the Personal Data Protection Act and in Regulation 2016/679 of the European Parliament and of the Council.

9. Other recipients of personal data

We do not share your personal data for commercial purposes or with third-party advertising networks, with the following exceptions:

  • hashed data or device identifiers (to the extent they are considered personal data in some countries);
  • cases where we have your special consent (e.g. forms generating potential contacts).

In addition to authorized KAM employees, your personal data may be accessed to a certain extent by persons who perform support activities for us:

  • operator of our IT systems – Legia, spol. s r.o.;
  • webmaster – Tomáš Frank – Propagon;
  • legal services – law firm, notary office and executor’s office, registered in the relevant professional chamber;
  • external accountant – FTA Consulting.

We will not pass to any other legal or natural person the CVs you sent to our selection procedure or the CVs you sent on your initiative.

We may need to share your data if we believe it is required by law or to help protect the rights and security of you, us and others.
